Terms of Service

1. Acceptance of Terms

By accessing or using KioKuu ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. We reserve the right to modify these terms at any time, and such modifications will be effective immediately upon posting.

2. Description of Service

KioKuu is a personal cloud storage service that allows users to upload, store, organize, and stream their own music files across multiple devices. The Service is designed for personal, non-commercial use of legally owned audio content.

3. User Accounts

To use the Service, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Providing accurate and complete registration information

4. User Content & Ownership

4.1 Your Content: You retain all ownership rights to the audio files you upload to KioKuu. We do not claim any ownership over your content.

4.2 User Responsibility: You are solely responsible for ensuring that you have the legal right to upload, store, and stream any content you add to your account. This includes music you have:

  • Purchased and own legitimate copies of
  • Created yourself (original compositions)
  • Licensed for personal use
  • Obtained through legitimate means with rights for personal storage

4.3 Prohibited Content: You may not upload content that you do not have the legal right to possess, content that infringes on third-party intellectual property rights, or content obtained through unauthorized means.

5. Personal Use Only

KioKuu is designed exclusively for personal, non-commercial use. You agree that:

  • Your content is for your personal listening enjoyment only
  • You will not use the Service to distribute, broadcast, or publicly perform content
  • Playlist sharing features are limited to authenticated users with temporary, revocable access
  • Shared content cannot be downloaded or redistributed by recipients
  • You will not use the Service for any commercial purposes

6. Subscription & Payment

6.1 Subscription Plans: Access to certain features requires a paid subscription. Subscription details, pricing, and storage limits are displayed on our pricing page.

6.2 Billing: Subscriptions are billed in advance on a recurring basis (monthly, semi-annually, or annually depending on your selected plan). Lifetime subscriptions are billed once.

6.3 Cancellation: You may cancel your subscription at any time. Upon cancellation, you will retain access until the end of your current billing period.

6.4 Refunds: Refunds are handled on a case-by-case basis. Contact support for refund requests within 14 days of purchase.

7. Copyright & DMCA Compliance

7.1 Respect for Copyright: KioKuu respects the intellectual property rights of others. We expect our users to do the same.

7.2 DMCA Takedown: If you believe that content on our Service infringes your copyright, you may submit a DMCA takedown notice to our designated agent. We will investigate and take appropriate action, which may include removal of the content and termination of repeat infringers.

7.3 Counter-Notification: If you believe your content was wrongly removed, you may file a counter-notification in accordance with the DMCA.

8. Termination

We reserve the right to suspend or terminate your account at any time for:

  • Violation of these Terms of Service
  • Uploading content you do not have rights to
  • Attempting to circumvent security measures
  • Fraudulent or abusive behavior
  • Non-payment of subscription fees

Upon termination, your access to the Service will cease, and we may delete your stored content after a reasonable grace period.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. YOU USE THE SERVICE AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIOKUU SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless KioKuu, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your content, or your violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration.
